Fitness Assessment Shows Depth
of Health Problems Among Youth

Less than a third of Texas' public school students in graded 3-12 met "healthy zone"
benchmarks for basic fitness, according to the first round of results from the new
fitness assessments authorized under SB 530 by Senator Nelson.  Third grade girls
fared the best with 32.09 percent designated in the healthy zone, while 12th grade
girls fared the worst with 7.82 percent hitting the benchmarks.  The assessment
measured students in body composition, aerobic capacity, strength, endurance and
flexibility.  

"We need to get back to the basics of ensuring basic health among our young
people," Senator Nelson said at a news conference this week at the Capitol.  "If we
want our children to get serious about fitness, we need to get serious about making
this issue a top priority."

Deloitte To Begin Construction
of New Campus in Westlake

Business continues to boom in North Texas with the recent announcement from
Deloitte LLP, which plans to build a $300 million training center in Westlake.  The
mega consulting firm intends to build a 750,000 square foot campus on 107 acres
with 2011 as the estimated completion date.  "We are very proud to welcome another
corporate partner to North Texas," Senator Nelson said.  "This is yet another sign that
the Texas economy is holding strong despite the national trends."

Supreme Court Rulings
A Mixed Bag for Texas

Senator Nelson was the first Texan to sign her name to a Women in Government's
brief to the Supreme Court asking that the Washington, D.C. handgun ban be
overturned.  She welcomed the Supreme Court's 5-4 decision striking it down.  "The
D.C. law trampled the Second Amendment of the Constitution, which clearly states
that our right to bear arms should not be infringed," Senator Nelson said.  

In another ruling with Texas implications, the Supreme Court ruled that the death
penalty for child rape is unconstitutional.  "As a co-sponsor of Jessica's Law, I favor
the harshest possible punishment for those who harm children," Senator Nelson
said.  "We are still trying to determine how this ruling will affect our new child
protection laws in Texas."

McCain's Plain Talking Style Kick's "Professor" Obama's Butt At the Saddleback
Church Forum Last Night

Admittedly John McCain and I are not ideological twins. However, last night’s forum
where both candidates were asked the same questions, one-on-one by the pastor
who wrote the best selling book, "The Purpose-Driven Life", in front of the same
audience, clarified the “it” difference between the two candidates for me.

Here are your choices:

A professorial-sounding candidate who looks bright giving well-rehearsed,
academic answers in razor-thin depth.
A ready-aim-shoot candidate who answered the questions in plain English complete
with personal life experiences to add depth for his audience.

In my personal life, I swing both ways … #2 as a business owner and #1 in a Higher
Ed leadership roll. My conclusion: If you want to get things done, vote for McCain. If
you want to get things talked about and talked about and talked about, vote for
Obama.

Choosing candidates is not a complicated task. In conservative circles we can ask
ourselves whether we’d prefer to have William F. Buckley or Ronald Reagan lead us
for the next four years.

FLOWER MOUND
FMPD Begins Cash Reward Program

The Flower Mound Police Department recently began using money seized from
criminals to catch criminals.

A new program allows for cash rewards to be given for anonymous tips that result in
an arrest related to crimes that occurred in Flower Mound. The rewards will be
funded exclusively through the Flower Mound Police Department's seizure fund, so in
effect, criminals will be helping catch other criminals.

The reward process will begin when a criminal case is selected and highlighted in
the media and on the Town's cable channel and Web site. Anyone providing a tip that
leads to an arrest will be eligible to receive a cash reward ranging from $50 to
$5,000. Callers with tips should call the non-emergency police number
(972.539.0525) to receive their anonymous tip code.

Police Arrest Suspected Pharmacy Robber

Flower Mound Police have arrested and charged a suspect in the recent string of
pharmacy robberies. Jeffrey Marshall Usvolk, 20, of Flower Mound was arrested on
August 9 and charged with an expired vehicle inspection, possession of a
dangerous drug, and one count of aggravated robbery.

Mr. Usvolk was stopped by a Flower Mound Police Officer for an expired vehicle
inspection in a silver Toyota Celica that matched the description of the car being
used in the robberies. The suspect has been positively identified through a photo
line up by several witnesses at the robbery locations. Police Detectives are preparing
additional charges to be filed with the District Attorney.

Continued Water Conservation Measures

In order to ensure all Flower Mound residents and businesses receive adequate
water pressure during peak usage hours, Flower Mound has transitioned the Stage
Two Water Conservation Measures to a geographical location-based system.

In accordance with the new system, residents and businesses with addresses east
of FM 2499 may water landscaping on Saturday, Monday, and Wednesday and those
with addresses west of FM 2499 may water landscaping on Sunday, Tuesday, and
Thursday. No outdoor watering is allowed between the hours of 10 a.m. and 6 p.m.
for any address.

The Stage Two Water Conservation Measures geographical location-based system
will remain in effect until further notice. Flower Mound's water system will continually
be monitored during this period to ensure an adequate water supply and sufficient

Roof Repair Inspections and Carbon Monoxide Safety
Due to the recent storms and the related hail damage, a significant amount of roof
work is currently being conducted in Flower Mound. The Fire Department and
Building Inspections division would like to remind residents that no permit is
required for replacement of the roof covering or shingles, however; if any portion of
the roof deck is being replaced a permit is required. If the house has gas installed to
heat water or heating units supplied with gas, it is a recommended practice to
request that a mechanical contractor inspect all vents that extend though the roof
before final payment is released to ensure they have not been disturbed. If the house
has flexible gas line system, care should be taken before nailing begins.

It is uncommon for vent stacks to become dislodged when just shingles are being
replaced, but it can happen during the re-roofing process, leading to carbon
monoxide leaks. In Flower Mound, a majority of the heating units are located in
ventilated attics that disperse to the outdoor air, not the air inside the home. A
dislodged vent may not necessarily be distributing CO into a home, but nonetheless
it should be reconnected by a professional.

Carbon monoxide (CO) is a gas that has no odor or color, but is very dangerous. It
can cause sudden illness and death. CO is found in combustion fumes, such as
those made by cars and trucks, lanterns, stoves, gas ranges and heating systems.
CO from these fumes can build up in places that don't have a good flow of fresh air.
CO poisoning is caused by breathing in the fumes. The most common symptoms of
CO poisoning are:

Headache , Dizziness, Weakness, Nausea, Vomiting,  Chest pain, Confusion

It is often hard to tell if someone has CO poisoning, because the symptoms may be
like those of other illnesses. People who are sleeping or intoxicated can die from CO
poisoning before they have symptoms. A CO detector can warn you if you have high
levels of CO in your home. For more information, visit the environmental protection

Pet Excrement Ordinance Reminder

The companionship of a pet is a wonderful thing, as many dog and cat owners will
agree. Coming home after a long, hard day at work to a wagging tail or playful purr is
a great way to exercise, relieve stress, and enjoy the simple things in life.

As we love and cherish the time we spend with our pets, it is also important to
remember to take care of the many respon­sibilities that come with pet ownership.
One of these tasks is the need to clean up your pet's excrement. Flower Mound is a
beautiful place to live, work, and play, and it is our individual duty to ensure that it
remains as such.

As a friendly reminder, the Town's code of ordinances requires that all manure and
other excrement be disposed of in such a manner to prevent it from becoming a
public nuisance. Doing so is environmentally responsible and will result in a
cleaner, more appealing neighborhood that everyone can enjoy.

Having a pet is a joy as they brighten the hearts of their owners. Being a responsible
and courteous pet owner, which in­cludes ensuring that excrement is cleaned up, is
necessary and required by the Town of Flower Mound. Let's work together to keep
Flower Mound a great community.

Texas Leads the Nation
in Energy Production

It should come as no surprise that Texas leads the nation in energy production. In
the midst of a national energy debate, several newspapers this month have taken
note of the fact that Texas leads the nation in energy production -- more than
doubling the energy production of the No. 2 state, California.  Oil has always been a
major part of the Texas economy, but Texas also produces more wind energy than
any other state and is home to one of the largest onshore natural gas reserves in the
country, the Barnett Shale, which spans 5,000 square miles and contains about 27
trillion cubic feet of natural gas in North Texas.  "What's happening with wind power
in Texas is very exciting, and it is one of the reasons I am so proud of our energy
portfolio.  It's incredibly diverse," Senator Nelson said.  "It's clear that Texas will play a
key role as we work toward energy independence."

Pediatric obesity is in epidemic proportions in the United States and worldwide.
Childhood obesity is defined clinically by body mass index (BMI). For children ages 2-
20, gender specific references exist. Overweight is defined as BMI between 85th and
94th percentiles while obesity is defined as 95th percentile and above.

Current studies show that early intervention (ages 4 to 7 years) is extremely
important in the prevention of childhood obesity. Studies also show familial
involvement to be integral in the success of prevention of overweight and obese
children.

How can I help my child?

·        Set a daily meal schedule (3 balanced meals and 2 healthy snacks)

o   Eat breakfast every day.

o   Serve fruits and/or vegetables at every meal.

o   Increase the number and variety of vegetables eaten.

o   Keep only healthy snacks in the home.

o   Offer snacks of fruits and vegetables. NOT fruit snacks and chips.

o   Avoid snacking directly out of the bag.

·        Limit fast-food consumption.

·        Set limits on food choices.

·        Turn off the TV during meals or snacks.

·        Limit consumption of juice and sweetened beverages.

·        Increase consumption of low-fat milk and dairy beverages.

·        Children should NOT be rewarded for “cleaning their plates”.

·        Increase consumption of water for thirst.

·        Use items other than high-fat food or candy to reward good behavior.

·        Parents & other family members should display the above dietary habits for the
child.

We are nearing the one year anniversary of this report, and to mark this occasion, we
have some positive news to share with you.

On August 5, 2008, convicted rapist and murderer Jose Medellin was executed. An
illegal alien who lived in Texas since he was infant and the member of the notorious
Black and Whites gang, Medellin had raped and murdered two Houston teenagers,
Jennifer Ertman and Elizabeth Peña, in 1993.

Medellin never mentioned to his defense team that he was actually illegally in the
United States until after his conviction, which consequently, would have brought
about much discussion regarding an international treaty that our nation signed back
in 1963. The Vienna Convention on Consular Relations promises to grant any
arrested alien immediate access to their country's consulate.

Prior to his execution date, the U.N. International Court of Justice issued a "stay" of
the execution, which President Bush even agreed with! Bush, Secretary of State
Condoleezza Rice and our Attorney General Michael Mukasey demanded a new trial
for Medellin.

To the credit of Governor Perry, Texas defied those who would meddle with justice.
Today, the murderer and rapist of two young girls is now dead.  In fact, our Supreme
Court determined that President Bush went above his authority when he tried to defy
the courts and intervene on behalf of these two criminals. Thankfully,

Texas is not bound by the opinions of the enlightened U.N. "World Court".  For now
the United Nations' attempt to usurp our laws and dictate a sovereign state's actions
has been thwarted.

The father of one of the victims, Randy Ertman, spoke about the stay of execution
proposed by the UN and the Bush Administration, saying, "It's just a last-ditch effort
to keep the scumbag breathing. He never should have been breathing in the first
place.

I don't care, I really don't care what anyone thinks about this except Texas. I love
Texas. Texas is in my blood."

We love Texas too, Mr. Ertman, and will continue to fight for Texas so that our children
can have a state to be proud of and a state that is not bound by an international
governmental authority like the United Nations.

Republicans Refuse to Cooperate with Democrats' Vacation Plans
An open letter from Tom Cole

Right now in Congress, Republicans are holding a revolt against the Democrat
Majority for taking a month-long vacation without holding a vote to drill for more
American oil.

As you may be aware, last Friday Speaker Pelosi gaveled the House to adjournment
for a month-long vacation WITHOUT voting on key energy legislation that could give
Americans relief from the high cost of fuel.  

Republicans announced we were prepared to stay and debate the energy bill to
increase the supply of American oil and reduce our dependence on oil from unstable
regimes in the Middle East.

So what did Speaker Pelosi do to show leadership? She turned out the lights, shut
off the microphones and tried to shut out reporters from covering the GOP debate.  
But that didn’t stop us. The House GOP took control of the floor and held a revolt to
demand that Democrats return to their job and vote on drilling.  

This morning, my colleagues and I returned to Washington to continue our efforts to
force the Democrats to return to work and get the job done for the American people.  
We’ve been on the House Floor this morning and will continue throughout this week
to keep pressure on the Democrats to hold votes on energy bills.  

While the Democrats have put priority on their 5-week long vacation, we are putting
priority on working for energy solutions by calling for votes on drilling for more
American oil.  

If you are as outraged as we are, speak out now by posting your comments on our
blog.  Encourage Republicans to keep up the pressure.  Tell Democrats to do the

And, check back tomorrow for more updates.  Americans can't afford the Democrat

City of Highland Village Drought Contingency Plan

City Initiates Phase 2 Water Restrictions Mandatory Phase 2 water restrictions
limiting landscape watering for Highland Village residents went into effect on
Wednesday, July 30. Phase 2 prohibits residential and commercial landscape
watering on Monday and Friday and restricts watering between 10:00 a.m.
and 6:00 p.m. the rest of the days. If your sprinkler system is set up on a timer,
please be sure to re-set your system so you are in compliance. Wasteful water runoff
is also prohibited, which includes hosing down pavement or rinsing off cars.
Groundwater well owners are required to post a sign showing well water is in use.

"It is important to conserve water and that we succeed in Phase 2 of our water
management program. We want our residents to understand we must be serious
about compliance and enforcement of this program to avoid moving to the very
restrictive Phase 3 restrictions," stated Public Works Director Matthew Kite.

The city parks and recreation department and all homeowners associations must
comply with Phase 2 restrictions and, additionally, the city has requested they reduce
their water consumption by 30%.

Phase 2 was triggered automatically by ordinance when the demand on the City
water supply reached 80% or greater for 3 consecutive days. Phase 2 automatically
terminates five weeks from initiation unless extended by resolution of the City
Council.

The City of Highland Village has an adequate water supply for today and tomorrow's
needs. Phase 2 is a water management plan to ensure reliable water quality and to
provide for reserves before and after the weekend.

AUSTIN – The Texas Department of Transportation’s (TxDOT) 2030 Committee
announced the four remaining public hearing dates today; the committee’s first
public hearing was held last week in Austin. These public hearings, held across the
state, give Texans the opportunity to share their perspectives on the state’s
transportation needs in the coming decades.

The purpose of the 12-member committee is to present an assessment of the state’
s transportation needs through the year 2030, in the context of today’s economic
reality. The committee will issue a report estimating the resources necessary to
meet those needs in December 2008.

Locations have not yet been confirmed for each of the upcoming meetings and times
listed are tentative. Those wishing to submit written testimony should come
prepared with 13 copies of any printed materials, and oral testimony will be limited to
three minutes.

Flower Mound Business Activity
▪ Spears Manufacturing is in the process of moving from Grapevine to their new
152,800-square-foot building in the Lakeside Business District. The company is an
industry leader in thermoplastic valves, fittings, and piping system components with
corporate offices in California. Spears Manufacturing has been in business for 39
years. The Flower Mound location will be a distribution facility with approximately 25
employees.

▪ The Flower Mound Community Activity Center (CAC) opened June 2008 and is has
been well-received by residents as well as businesses. The economic impact of the
CAC equates to approximately 20,000 visitors each month, which is a significant
draw to this area of Flower Mound. This is anticipated to result in renewed interest by
retailers/restaurants regarding neighboring retail sites.

▪ A.G. Edwards, located at 1501 Cross Timbers, has changed their name to
Wachovia Securities.

Use of Hand-Held Cell Phones Prohibited in Active School Zones

Starting August 25th, a new ordinance goes into effect prohibiting the use of hand-
held cell phones in active school zones.  Violators are subject to being cited and
fined in Municipal Court.  

IT IS UNLAWFUL:

To drive or operate a motor vehicle in an active school zone while using a hand-held
mobile telephone to engage a call or to create, send or read messages.
A hand-held mobile telephone includes a personal digital assistant or other device
operated for data communication other than voice.
ORDINANCE EXCEPTIONS:

When being used in a hands-free manner.
Emergency communications with 911 operator, hospital, physician's office or clinic,
or public safety department.
Law Enforcement, EMS and Fire Safety personnel in performance of duties.

Texas Celebrating "National Night Out" in October

National Night Out this year will be observed on Tuesday, October 7, 2008 instead of
in August as in previous years.  National Night Out is sponsored by the National
Association of Town Watch.  That evening residents are encouraged to get out and
meet with their neighbors.  Good neighbors looking out for each other is an proven
crime prevention strategy.  HVPD police officers will be out that evening and available
to stop by on request at any neighborhood gathering.

Denton County:

ALDI
is coming to the area. ALDI is a German based grocery chain.  
Denton County Commissioner's Court approved a 35% tax abatement
with a 3 to 1 vote. The one nay vote was Denton County Judge
Mary

, stating her opinion that Denton County already has the lowest
taxes.
Aldi will be housing it's Southwest Regional offices and Distribution
Center in Denton. The Aldi format is about the size of a Walgreen's with
prices comparable to Walmart.
Aldi director of Real Estate, Texas Division, Karla Waddleton stated
"They are looking for around 50,000 population size towns. Denton and
Lewisville will probably get the first of the stores.

avocados
2 tablespoon lime
juice
1/2 cup finely
chopped onion
1/2 cup finely
chopped fresh
cilantro
2 finely chopped
jalapeño peppers
3/4 cup cubed
and drained ripe
tomato
salt to taste


Cut avocados in
half, remove
seeds, and scoop
out pulp with a
spoon. Mash pulp
